FACTS
On July 11, 2018, claimants’ decedent Sook Chung, 90, was a front-seat passenger in a vehicle operated by In Sun Kwon. As they were traveling in Monterey, Kwon drove over a center median, mounted a sidewalk and crashed into a tree. Chung suffered fatal . In lieu of filing a lawsuit, Chung’s husband, Hai Chung, and four adult daughters, Julie Riddleberger, Shirley Chung, Margaret Prodis and Susan Chung, sought direct recovery from Kwon’s insurer, State Farm Insurance Cos. The survivors alleged that Kwon was negligent in the operation of her vehicle., Although the vehicle’s air bags deployed, Sook Chung suffered crushing , including fractures of her neck, sternum, ribs and back. She also suffered a hemopneumothorax, pleural effusion, a herniation of her bowel, a laceration of her spleen, and contusions and lacerations. Over the course of the next two weeks, Chung remained hospitalized, but she developed infections and her condition progressively became worse. She died two weeks after the accident. Chung was 90 years old. She was survived by her husband and her four adult daughters. Chung’s family sought recovery of wrongful death damages. They also sought recovery of $74,949 in past adjusted medical costs and an unspecified amount of damages for Chung’s conscious pain and suffering for the two weeks she was alive at the hospital.
