On Nov. 22, 2018, applicant Caesar Laura, 40, a construction supervisor, was working on a ladder at Dignity Health – California Hospital Medical Center, in Los Angeles. As he was looking at ceiling lights, he encountered an energized wire and was knocked to the ground. Laura claimed to his head and right hand. Laura filed a workers’ compensation claim against his employer, Tiller Constructors Partnership Inc., which was insured by Hartford Insurance Group. He brought a claim against Tiller Constructors in an attempt to collect workers’ compensation benefits., When Laura suffered an electric shock, he sustained third-degree burns to his right hand, and he suffered a heart attack, resulting in respiratory arrest. As a result, he was unconscious for 15 minutes. In addition, Laura claimed he suffered an anoxic brain injury as a result of the incident. He was emergently admitted to Dignity Health – California Hospital Medical Center, where he was placed on a respirator as a result of his neurocognitive impairment. Laura remained in the hospital for one month before being transferred to a neurorehabilitation facility in Bakersfield, where he began inpatient neurorehabilitation on Dec. 27, 2018. Laura was ultimately discharged home, where his wife, who is his guardian ad litem, and three children care for him. Laura sought recovery of medical costs for his medication and ongoing assistance at home. The respondent’s counsel asserted that Laura could have been discharged from medical care sooner. Counsel also asserted that Laura’s wife did not work, so she would be able to take care of her husband.
