During a period that spanned October 2014 and Oct. 1, 2015, plaintiff Mahim Khan, a production assistant in her 30s, worked for FilmOn TV and Alki David Productions Inc. She claimed that, during that time, she was subjected to acts of inappropriate behavior on the part of the companies’ owner, Alkiviades David. Khan claimed that David performed degrading acts and groped her. Khan sued David; Alki David Productions Inc.; FilmOn TV Inc.; and another company owned and operated by David, Hologram USA Inc. Khan alleged that David’s actions constituted battery, sexual battery and sexual harassment and that the companies created a hostile work environment by failing to address the situation. Hologram USA was ultimately removed as a defendant. Khan claimed that, on numerous occasions, David would grab her neck and bring it toward his crotch, sometimes making contact. She also claimed that David grabbed her vagina and breasts on a number of occasions and that David performed a lap dance on her in front of a company client. She further claimed that David continually subjected her to sexually degrading comments and conduct in the workplace and that David’s inappropriate behavior occurred almost every day. David denied he committed the acts alleged by Khan, and claimed that there were witnesses who would have disputed Khan’s version of events, but that Judge Michelle Williams Court denied him the opportunity to present those witnesses. The companies’ counsel argued that David was not a sexual predator and that, therefore, the companies were not legally responsible for the alleged work environment., Khan started working for David in October 2014, and she ultimately resigned from her position on Oct. 1, 2015. Khan claimed that after being subjected to David’s harassment for months, she became withdrawn from friends and preferred to stay home. She also testified that she gained 30 pounds. The plaintiff’s psychology expert opined that Khan suffered from major depressive disorder and post-traumatic stress disorder as a result of her experience at David’s companies. The expert explained that, as of the time of trial, Khan had been in a depressed mode for four years, but that he believed that Kahn could improve. The expert opined that Khan would benefit from two years of therapy, but that he was doubtful Khan would ever make a full recovery. Khan sought recovery of noneconomic damages for her past and future pain and suffering. She also sought recovery of punitive damages against David as a result of his conduct.
