On March 4, 2010, plaintiff Nico Colon, 15, was attacked from behind by Christian Ramos, another 15 year-old student in a classroom at Chino Hills High School. Before the incident, the boys’ teacher stepped outside of the classroom to speak with two other students. Christian then punched Nico in the back and front of the head. Robert and Michelle Colon, who were acting as Nico’s guardians ad litem, sued Jose and Jennifer Ramos, who were acting as Christian’s guardians ad litem for Ramos, and the Chino Valley Unified School District. The Colon’s alleged that Christian’s actions constituted battery. They also alleged that the school district was liable for the incident due to the negligent supervision of the classroom. Prior to trial, the Chino Valley Unified School District settled with Nico for $40,000. Christian conceded liability, and the matter proceeded to a trial on damages against Christian only., Nico sustained an orbital fracture below his right eye and a fractured nose, plus general soft-tissue . He was subsequently treated by his family doctor, but required no surgical treatment for his . However, Nico remained on hospital and home care for two months. Nico claimed he had pain at the time immediately following the incident, but now only has some residual pain. He was ultimately able to return to school. Christian and his parents appeared pro se.
