FACTS
On Dec. 21, 2016, plaintiff Brittany Jones, 24, a clerk, was driving on Santa Monica Boulevard, in Los Angeles. When she was between Manning Avenue and Overland Avenue, the front of her vehicle was struck by a vehicle operated by AmirHessam Hemmat. Jones claimed that she suffered of her back, a hip, her neck and a shoulder. Jones sued Hemmat. The lawsuit alleged that Hemmat was negligent in the operation of his vehicle. Jones claimed that Hemmat made an illegal U-turn, causing the accident. Defense counsel conceded liability. The trial addressed damages., Jones claimed that she suffered of soft tissue of her back and neck. She also claimed that she suffered a laceration of a hip and a nonspecific injury of a shoulder. During the day that followed the accident, Jones visited a doctor. Jones ultimately underwent four to five months of physical therapy. Jones claimed that she suffers residual diminution of the range of motion in her back and neck. A doctor has recommended a painkilling facet-block injection. Jones claimed that she was passionate about pursuing a professional dancing career prior to the accident. She claimed that her decreased range of motion caused her to be unable to dance for a few months and that, as a result, she lost dancing opportunities. She also claimed that she is not the same person she was prior to the accident and that her halted her career, causing her to relocate from California for a few years. She claimed that it is now more difficult for her to dance for long periods of time and that even if she dances better than a normal dancer, it is not at the competitive level to which she once aspired. Jones sought recovery of past medical expenses, future medical expenses, damages for past pain and suffering, and damages for future pain and suffering. The parties stipulated that Hemmat’s negligence was a substantial factor in causing Jones’ harm, but the defense disputed the severity of Jones’ alleged . The defense presented a video of Jones dancing from February 2017, approximately two months after the accident. The defense’s orthopedics expert opined that Jones’ physical therapy was reasonable and necessary but disagreed that Jones requires a facet-block injection.
