FACTS
On Dec. 3, 2018, plaintiff Christian Martinez was bicycling on northeast Mission Street, just past its intersection with Virginia Avenue, in San Francisco. He was struck by a vehicle operated by Anthony Alonzo, who was making a right turn right into a parking spot. Martinez suffered an injury of a shoulder. Martinez sued Alonzo and the owner of Alonzo’s vehicle, Alonzo’s employer, the city and county of San Francisco. Martinez alleged that Alonzo was negligent in the operation of his vehicle and that the city and county of San Francisco was vicariously liable for Alonzo’s actions. Martinez’s counsel contended that Alonzo failed to keep a proper lookout and failed to yield the right of way to traffic, causing the collision., Martinez sustained a fractured clavicle. Martinez sought recovery of past medical costs, and damages for his past pain and suffering.
