On May 6, 2016, plaintiff Brian Soo, a physical therapist, was riding his electric bicycle on southbound Mission Street, between Valencia Street and 29th Street, in San Francisco, when he was ejected from his bicycle. Soo sustained to his right elbow and head. Soo sued the owner of the roadway, the city and county of San Francisco, alleging that the city and county of San Francisco failed to properly repair and/or maintain the roadway, creating a dangerous condition of public property. He also alleged that the city and county of San Francisco failed to warn of the hazardous condition. Plaintiff’s counsel contended that Soo’s bicycle struck uneven and cracked pavement, causing Soo to be ejected from the bicycle. Counsel contended that the city and county of San Francisco was negligent in failing to repair the defect or place warnings about the dangerous condition., Soo sustained bodily contusions and a right elbow sprain. He also claimed he suffered blunt force trauma to his head. He was taken to a hospital, where he was treated and released. Soo claimed that he suffers from recurring headaches as a result of the accident. However, he admitted that he has no limitations and that since the street has been repaired, he has recently resumed riding his bicycle. He also claimed that he has returned to work. Soo sought recovery of past medical costs, and damages for his past and future pain and suffering.
