FACTS
On Oct. 23, 2019, plaintiffs’ decedent Valerio Estrada, 89, was riding an adult tricycle. He was struck by a tractor-trailer. The incident occurred on the eastbound side of Lakeville Street, near its intersection at a feeder road of U.S. Route 101, in Petaluma. Estrada suffered a fatal injury. Estrada’s widow, Martha Rodriguez, and the couple’s children, David Estrada, Jorge Estrada, Luz Estrada, Pilar Estrada, Rosario Estrada and Valerio Estrada, sued the driver of one of two tractor-trailers that was traveling in the area in which the accident occurred, Mike Auradou, and the owner of Auradou’s rig, Clover Stornetta Farms Inc. The lawsuit alleged that Auradou was negligent in the operation of his vehicle. The lawsuit further alleged that Clover Stornetta Farms was vicariously liable for Auradou’s actions. Plaintiffs’ counsel contended that the accident occurred a moment after Auradou had proceeded forward from a stopped position at a traffic signal. Auradou claimed that his rig was not involved in the accident., Estrada suffered a fatal injury. He died at the scene of the accident. Estrada, 89, was survived by his wife and six adult children. The survivors sought recovery of wrongful-death damages.
