On Sept. 18, 2016, claimant William Zimmerman, 67, a co-owner of a business, was bicycling in a long-distance bicycle relay race in a rural area near Fallon, Nev. A driver in a support vehicle that was trailing Zimmerman fell asleep at the wheel and struck Zimmerman’s bicycle. Zimmerman claimed to his right shoulder, right foot and a knee. The driver’s insurer tendered its $100,000 policy limit. Zimmerman sought further recovery via the supplementary-underinsured-motorist provision of his own insurance policy, which was administered by CSAA Insurance Group, an agent of American Automobile Association., Zimmerman sustained rotator cuff tears to his right shoulder, two fractures to the third and fourth metatarsal bones of his right foot, an anterior cruciate ligament tear in a knee, a meniscus tear in a knee, and contusions and abrasions over his entire body. He ultimately underwent surgery on his rotator cuff tears. Zimmerman had $18,600 in past medical costs, post Howell. He also sought recovery of an unspecified amount of damages for his pain and suffering. (He did not make a claim for any lost wages.)
