FACTS
At approximately 5:30 p.m. on Jan. 22, 2014, plaintiff Rami Zeeni, 35, a personal trainer, was riding his bicycle on the south sidewalk of Westminster Avenue, in Westminster. As he was heading west from his home to a gas station near the intersection with Bolsa Chica Road, he was struck by a vehicle operated by Kristy Bowman, who was leaving the parking lot for Frank’s Liquor Store. Bowman was traveling north out of the parking lot and attempting to make a right turn onto eastbound Westminster Boulevard when the accident occurred. Zeeni claimed to his left ankle, right knee, and right shoulder. Zeeni sued Bowman, alleging that Bowman was negligent in the operation of her vehicle. Plaintiff’s counsel contended that Bowman failed to take the appropriate care to look both ways and make sure she was clear before initiating her right hand turn. Defense counsel contended that Zeeni was liable for riding his bicycle on the sidewalk against the flow of street traffic., After the accident, Zeeni went home thinking he would feel better on his own. However, he claimed that when his had not improved approximately one week after the accident, he sought medical treatment. Zeeni claimed bruising and swelling to his left ankle; bruising and swelling to his right knee; and pain, stiffness, limited range of motion, and weakness to his right shoulder. Based on an MRI, he was ultimately diagnosed with tenosynovitis – or inflammation and swelling — on the right bicep tendon where it attached to the shoulder. Zeeni subsequently underwent chiropractic manipulations, electrotherapy, physical therapy, and one steroid injection into the right bicep tendon. Zeeni claimed that in addition to his physical , he had property damage to his bicycle, which he claimed was rendered a total loss. Defense counsel denied that Zeeni was injured.
