In September 2007, plaintiff-intervenor Farhang Dahmubed, a man with retinitis pigmentosa, a degenerative eye condition that causes severe vision impairment and often blindness, was hired as a senior bookkeeper at Riviera Consulting & Management Consulting LLC. Dahmubed claimed that within one month of his hiring, he was terminated from his position due to his vision impairment. After unsuccessful conciliation efforts plaintiff U.S. Equal Employment Opportunity Commission sued Riviera Consulting and Management LLC and its associated companies, Ali Baba Corp., Oasis Care Inc., and Sabankaya Select LLC for discriminating against Dahmubed on the basis of disability in violation of the Americans with Disabilities Act. Dahmubed intervened in the suit. Plaintiff’s counsel contended the defendants terminated Dahmubed from his position because of his disability without engaging in any interactive process to find a reasonable accommodation for newly created job duties related to driving. Defense counsel contended Dahmubed was fired because he was unable to perform the tasks of a bookkeeper and was falling behind in his job performance., The EEOC sought to have Dahmubed recover compensatory damages, including back pay and other monetary losses, as well as recover punitive damages. It also sought appropriate injunctive relief to prevent future discrimination.
