FACTS
On Feb. 9, 2019, claimant Adriana Giacomelli, 84, a retiree, was driving on Pine Avenue, in Pacific Grove. As she entered an intersection with Congress Avenue, her sport utility vehicle was broadsided by a pickup truck operated by a 79-year-old man, who entered the intersection from Congress Avenue after running a stop sign. Giacomelli claimed head, neck, back, abdomen, ribs, chest, hip and shoulder . In lieu of filing a lawsuit, Giacomelli sought direct recovery from the tortfeasor’s insurance provider, California Casualty Group. Giacomelli alleged that the tortfeasor was negligent in the operation of the pickup truck. Giacomelli did not think that California Casualty Group’s policy was sufficient to cover her , so she also sought recovery via the supplementary-underinsured-motorist provision of her own insurance policy, which was administered by The Hartford Insurance Group., Giacomelli was transported from the scene to Community Hospital of the Monterey Peninsula, in Monterey, where she was treated and released. Giacomelli was diagnosed with a concussion. She also had soft tissue to her neck and lower back, plus contusions to her shoulder, chest, ribs, abdomen and left hip. Her only treatment after leaving the hospital involved visits with her primary care doctor. Giacomelli claimed ongoing residual . She alleged that she has difficulty performing daily activities such as laundry, sweeping, making her bed, cooking and taking out the trash. She further claimed that she had to start ordering from an online meal service and required assistance with personal care and medication reminders. Giacomelli sought recovery of approximately $7,000 in past adjusted medical expenses. She also sought recovery of damages for her past and future pain and suffering.
