On Dec. 18, 2010, at approximately 6:35 a.m., plaintiff Michael Rhinehart, an unemployed 50 year old, was a passenger in a bus traveling on northbound Broadway in Los Angeles when it entered the intersection and was involved in a collision with a vehicle traveling on the intersecting road of 4th Street. Rhinehart claimed to his neck and back. Rhinehart sued the respective drivers and the bus company. Rhinehart alleged the drivers were negligent in the operation of their respective vehicles and that the bus company was vicariously liable for the bus driver’s actions. Rhinehart claimed the driver on 4th Street ran a red light at the subject intersection, in violation of California Vehicle Code § 21453(a), causing the collision with the bus. He further claimed the bus driver contributed to the accident., Rhinehart claimed a neck strain, as well as a lumbar strain/sprain, contusion and spasm. He also claimed a cranial contusion. Rhinehart sought recovery of $3,653.09 in past medical costs. He also sought recovery of damages for his pain and suffering. Defense counsel disputed the nature and extent of Rhinehart’s alleged damages.
