On Oct. 28, 2011, applicant Marco Rodriguez, 24, a cable installer for Cable Brothers, was working on a post in Huntington Park when he fell approximately 30 feet onto the ground. He subsequently fractured his skull and right femur. Rodriguez sued his employer, Cable Brothers, and the workers’ compensation insurance carrier, State Compensation Insurance Fund. Rodriguez brought a claim against the defendants to collect workers’ compensation benefits., Rodriguez sustained fractures to his skull and right femur. He was subsequently rushed to a hospital, where it was discovered that his lungs had collapsed. As a result, Rodriguez required intubation with a tracheotomy and feeding tube. He then spent five weeks at the hospital before making a miraculous recovery. Rodriguez was then transferred to an acute care rehabilitation facility and, later, was again transferred to an inpatient neuro-rehabilitation facility, where he was treated until July 2012. He then continued treatment at a neuro-rehabilitation facility on an outpatient basis before being discharged home prematurely. Rodriguez’s counsel was able to secure Rodriguez continued neuro-rehabilitation with the help of a neuropsychologist and physiatrist, who both opined that Rodriguez required further speech, occupational, psychological, and physical therapy. Rodriguez’s counsel contended that as a result of the traumatic brain injury, Rodriguez suffers from retrograde and anterograde amnesia, severe cognitive deficits, memory loss, depression, anxiety, and other behavioral issues, as well as tinnitus, vertigo, and vestibular dysfunction. Counsel also contended that Rodriguez, who was a father of two minor children (a 3 year old and a 6 month old), would require lifelong care in a structured living environment and medical care by multiple specialists.
