On Feb. 6, 2010, plaintiff Theresa Cisek Free, a retired 77-year-old, was at the Commerce Casino located at 6131 Telegraph Road in Commerce, Calif. As she walked toward an elevator, she slipped and fell, allegedly causing an injury to her hip. Free sued Commerce Casino. She alleged that the defendant failed to properly maintain the area, creating a dangerous condition. Free claimed that as she walked toward an elevator, she slipped in liquid that was left on the floor, causing her to fall. Defense counsel contended that the casino conducted a routine inspection of the area minutes before the accident and found that no liquid was on the floor and that there was no dangerous condition., After the accident, Free was taken to nearby Alhambra Hospital. She claimed that she suffered a hip fracture in the fall. On Feb. 7, 2010, Free underwent internal fixation surgery to address the injury to her hip. Free sought recovery of general and special damages. Defense counsel denied the fall caused Free’s injury and argued that when a person slips and falls on water, he or she would fall backward. Counsel also presented video surveillance and contended that it showed Free falling sideways. The defense’s biomechanics expert opined that Free had osteoporosis and that her hip fractured suddenly, causing her to fall. The expert further noted that those with osteoporosis can be just walking down the street when they incur a sudden hip fracture.
