FACTS
On Aug. 26, 2010, plaintiff Lucian Castro, 11, was playing hide-and-seek with his friends between 11400 and 11401 Amboy Avenue in Los Angeles. Lucian was hiding behind a tree when he turned to run away from his friends, who were trying to tag him, and he ran into a street sign on a dead-end street. He was cut by the lower diamond area of the sign, resulting in lacerations above and below his right eye. Monica Arreola, acting as Lucian’s guardian ad litem, sued the city of Los Angeles. Arreola alleged that the defendant improperly installed the sign, creating a dangerous condition. Arreola claimed that the sign was installed too low and that the edges of the sign should have been beveled, but they were not. Thus, she claimed a passerby could easily suffer from coming into contact with the sign. The city conceded that the sign was improperly installed, but contended that Lucian knew the sign was there, as his house’s backyard was in front of the sign. It also contended that the unsupervised children were playing and that children can get hurt while playing., Lucian suffered facial lacerations above and below his right eye. He was subsequently taken to a hospital, where his lacerations were stitched. Lucian is left with a 1.5-inch scar above his right eyebrow and another scar below his right eye, at his cheek.
