FACTS
On May 1, 2010, between 3 and 3:25 a.m., plaintiffs’ decedent Olga Martinez was murdered by her estranged husband, Napoleon Eduardo Castro, at the Glenoaks Townhomes located at 11150 Glenoaks Boulevard in the city of Pacoima. Glenoaks Townhomes is a gated community managed by Aberdeen Management Co. and secured 24 hours by guards from Mulholland Security & Patrol Inc., which was doing business as The Centurion Group. The decedent’s children, Marlene Martinez, Eddie Castro and a minor son, Eric Castro, sued Mulholland Security, Glenoaks Townhome HOA and Aberdeen Management. The decedent’s children alleged that the defendants failed to provide adequate security, making them liable for their mother’s wrongful death. The matter ultimately only continued against Mulholland Security. Plaintiffs’ counsel contended that Mulholland Security knew Napoleon Castro was not permitted onto the property, but on the subject date, he was allowed to enter the locked gated townhomes complex, where the decedent and her three children, who were all minors at the time, resided. Counsel also contended that even though Mulholland Security was advised that Napoleon Castro was not a wanted guest, was provided a copy of a restraining order, and was warned that Napoleon Castro was dangerous and not to be allowed in, the security company still allowed the estranged husband onto the property. Mulholland Security disputed the existence of a restraining order and denied having any prior notice relating to Napoleon Castro’s entrance onto the property. It also claimed that the “rules” at Glenoaks Townhomes were changed to allow non-residents onto the property without prior approval from a resident. In addition, Mulholland Security claimed that Napoleon Castro had been allowed on the property on numerous occasions prior to the incident, without any issue or complaints by the decedent. Counsel for Mulholland Security asserted that no restraining order was in effect, and the court granted a motion to strike this from the complaint after taking judicial notice of the issue., Olga Martinez died between 3 and 3:25 a.m. on May 1, 2010. A neighbor ultimately found her body at 6:30 a.m. The decedent left behind three children, who were all minors at the time. Thus, the decedent’s children sought recovery of wrongful death damages.
