In September 2017, the plaintiff, a Brentwood police officer, attended a conference in Reno, Nev., with Police Lieutenant Salvatore DiMercurio and another officer. She claimed that DiMercurio sexually assaulted her in a hotel room during the trip and that the Brentwood Police Department attempted to cover up the incident. The plaintiff sued DiMercurio and the city of Brentwood. Plaintiff’s counsel noted that, after the incident was reported by the plaintiff’s husband to the city of Brentwood, two of DiMercurio’s colleagues in the department’s administration opened a supervisory inquiry, instead of an internal-affairs investigation. Counsel contended that a supervisory inquiry would mean that no wrongdoing occurred and that no one would be subject to discipline. Plaintiff’s counsel asserted that DiMercurio and his friends in the police department administration tried to entice the plaintiff to drop her complaint by dangling a promotion in front of her if she kept quiet. Counsel also claimed that DiMercurio repeatedly harassed the plaintiff to drop her complaint and that DiMercurio constantly showed up at the plaintiff’s calls and interfered with her work until she went on medical leave. Plaintiff’s counsel further claimed that other complaints against DiMercurio were also covered up by the department. The city disputed the plaintiff’s claims, alleging that the accusations were “unsubstantiated.”, The plaintiff claimed that she suffered emotional distress as a result of the assault and attempts to cover it up. The plaintiff sought recovery of damages for emotional pain and suffering.
