FACTS
In March 2017, plaintiff Monica Ochoa, a senior accounting technician for the city of Lynwood, allegedly began to be sexually harassed by Lynwood City Councilman Edwin Hernandez. Ochoa claimed that she complained to the city in December 2017, but that nothing was done. Hernandez completed the term he was elected to on Dec. 4, 2018. Ochoa sued Hernandez and the city of Lynwood. Ochoa alleged that Hernandez’s actions constituted sexual harassment and that city was liable for Hernandez’s actions. Ochoa claimed that Hernandez made sexually inappropriate comments to her and sent her text messages with inappropriate comments. She further claimed that when she informed the city about the incidents, it failed to do anything about them. In addition, Ochoa claimed that after she filed the lawsuit, the city wanted her to quit and retaliated against her by putting her on an indefinite leave of absence. Hernandez denied all of Ochoa’s allegations. The city’s counsel denied that the alleged conduct rose to the level of sex harassment under the law. Counsel also contended that the city took all reasonable steps to prevent the alleged sex harassment., Ochoa claimed that Hernandez’s behavior and comments often made me her feel very uncomfortable and disgusted in the workplace. She sought recovery of emotional distress damages.
