On July 18, 2012, at approximately 3:45 p.m., claimant Rayna Harman, 72, a retired schoolteacher, was driving her 1995 Pontiac on southbound 50th Street in Palmdale when her vehicle was rear-ended by a 2006 Dodge Magnum operated by Christopher Boni. Harman’s vehicle was then pushed forward into a third vehicle, which had stopped after rear-ending the van ahead of it. Harman brought a claim against Boni’s insurer, alleging that Boni was negligent in the operation of his vehicle. Based on the remaining amount on Boni’s policy, Harman sought further recovery via the supplementary-underinsured-motorist provision of her own insurance policy, which was administered by Interinsurance Exchange of the Automobile Club., Harman sustained minimally displaced fractures of the 7th and 8th ribs, a lung contusion, a nose laceration, a severe left hip contusion, bilateral arm sprains and contusions, and cervical and lumbar strains. She was subsequently transported by American Medical Response to Palmdale Regional Medical Center, where her lacerations and contusions were treated. Harman treated her remaining with physical therapy and aquatic rehabilitation. Harman claimed she suffers anxiety as a result of the accident. Thus, she sought recovery of approximately $32,479.75 in medical expenses and an unspecified amount of damages for her pain and suffering.
