FACTS
On May 14, 2008, claimant Najiba Moosa, a 77-year-old unemployed woman, was stopped at a red light on southbound Camino Ruiz, at the intersection with Carrol Canyon Road in San Diego, when her vehicle was struck by another vehicle. She sustained to both knees and her back. Moosa settled with the motorist for the policy limits of $50,000. She subsequently sought recovery from the underinsured-motorist-provision of her own insurance policy, which was administered by AAA Insurance. The matter subsequently went to arbitration., Moosa sustained meniscal tears in two places of her left knee. She also claimed pain to her right knee and a cervical sprain/strain. In addition, she claimed $18,000 in damage to her vehicle. The claims adjuster contended that Moosa was in a subsequent one-vehicle rollover accident, so her could not be causally related to the subject accident. Additionally, the adjuster contended that Moosa had a prior left knee complaint, which was documented by her primary care physician.
