Plaintiff Domonique Hines was employed as a “Team Member” for a KFC restaurant. She claimed that since Oct. 2, 2005, her employer failed to pay her and other “Team Members” the correct amount for missed break periods and off-the-clock work. Thus, Hines, acting individually and on behalf of all others similarly situated, brought a class action against her employer, KFC U.S. Properties Inc. She alleged that KFC’s failure to pay appropriate wages constituted violations of California’s Labor Code and Business and Professions Code. Hines represented herself and a class of more than 13,000 current and former non-exempt employees of KFC U.S. Properties Inc. who were employed in California in the position of “Team Member” at any time since Oct. 2, 2005. She claimed that KFC failed to properly compensate her and the class for missed, late, or short meal and rest break periods, as required by California law, and failed to properly pay her and the class for off-the-clock work performed after KFC’s restaurants’ close. She also claimed that KFC failed to pay her and the class the appropriate overtime and minimum wages rate. In addition, she claimed that KFC failed to provide her and the class with accurate records of the hours worked or timely pay all wages due to employees whose employment with KFC had ended, as required by California law., Hines sought recovery of damages in the form of monies owed to herself and the class, as well as penalties against the company for violations of the Labor Code and Industrial Welfare Commission wage orders. In addition, she sought recovery of nominal damages, compensatory damages, civil penalties, punitive and exemplary damages, costs of the suit and attorney fees on behalf of herself and the class.
