FACTS
Plaintiffs John Hopkins and Brody Puckett, both sales representatives, claimed that their employer, Stryker Sales Corp., failed to reimburse them for various sales expenses during the period of 2008 through April 19, 2011. Hopkins and Puckett, acting on behalf of themselves and all others similarly situated to recover out-of-pocket expenses, penalties and interest, filed a class action against Stryker. They alleged that Stryker violated California’s Labor Code §2802, the California Business & Professions Code §§ 17200, et seq., the applicable wage order(s) issued by the California Industrial Welfare Commission, and related common law principles. Specifically, the class’ counsel contended that Stryker failed to properly reimburse and/or indemnify the class members for the necessary expenditures or losses incurred in direct consequence of the discharge of their duties, or of their obedience to the directions of the employer, including mileage, sales materials, cell phone charges, and the like, in violation of Labor Code § 2802., The class sought recovery of unspecified nominal damages and compensatory damages for the restitution of all monies due to the class and disgorged profits from the alleged unlawful business practice, as well as all penalties permitted by the Labor Code Private Attorneys General Act.
