In March 2016, the claimant, a pregnant woman and a courtesy clerk at a Ralphs grocery store in San Diego, requested a schedule change, as an accommodation for her pregnancy. However, her request was denied. The courtesy clerk claimed that her requests for accommodation continued to be denied and that she was ultimately forced to quit in June 2016. The U.S. Equal Employment Opportunity Commission attempted to reach a pre-litigation settlement through its conciliation process, but it ultimately filed a lawsuit against the operator of the store, Ralphs Grocery Co. The EEOC alleged that Ralphs failed to accommodate the pregnant clerk and that Ralphs’ ongoing pregnancy discrimination caused the employee’s constructive discharge in violation of Title VII of the Civil Rights Act of 1964, as amended, and the Pregnancy Discrimination Act of 1978. Defense counsel contended that the pregnant clerk was not discriminated against by Ralphs denying the employee her requested schedule changes., The courtesy clerk worked at the Ralphs store from December 2015 until June 21, 2016. She claimed she suffered emotional distress as a result of the alleged discrimination. She also claimed that she suffers from a loss of income as a result of the constructive discharge. The courtesy clerk sought recovery of past lost earnings, future loss of earnings, and damages for her past and future emotional pain and suffering.
