FACTS
On Feb. 24, 2015, plaintiff Chelsea Schrimplin, a hairstylist in her 20s, was driving in Oakland when her vehicle was struck nearly head-on by a vehicle operated by Nellni Singh, who was attempting a left turn. Schrimplin claimed to her neck. Schrimplin sued Nellni Singh and the owner of the vehicle, Satyendra Singh. Schrimplin alleged that Ms. Singh was negligent in the operation of her vehicle and that Mr. Singh was vicariously liable for Ms. Singh’s actions. The Singhs admitted liability prior to trial., Schrimplin claimed she sustained cervical facet joint at the C4-5 and C5-6 levels. She underwent a nerve conduction study, which showed impingement on the cervical spine. Schrimplin treated with physicians over the course of three years and had multiple rounds of physical therapy. She also received medial branch nerve blocks at C4-5 and C5-6, as well as multiple injections. Schrimplin claimed that she had some relief, but that she continues to have chronic neck pain. Schrimplin alleged that she finished cosmetology school prior to the collision and that although she attempted to return to work as a hairstylist and work through her pain, her chronic pain caused her severe limitations for everything she did. She also alleged that she is no longer being able to stand or lift her hands. The plaintiff’s pain management expert opined that Schrimplin would eventually require either a cervical fusion or a laminectomy. Schrimplin sought recovery of future medical costs, and damages for her past and future pain and suffering. The defense’s expert orthopedic surgeon opined that Schrimplin only sustained soft tissue and that the should have resolved 90 days after the collision. The expert also testified that he did not believe that Schrimplin had any chronic pain.
