FACTS
On April 16, 2019, claimant Jaime Monroy Jr., 51, a mechanic, was driving on Enrico Fermi Drive, in San Diego. Claimant Jonathan Campos, 59, was a front-seat passenger. As they entered an intersection with the exit for State Route 11, their vehicle broadsided the driver’s side of a vehicle operated by Stacey Poon, who was making a left turn off of State Route 11, onto Enrico Fermi Drive. Monroy claimed to his back, neck and left knee. Campos claimed to his back and left knee. In lieu of filing a lawsuit, Monroy and Campos filed a claim with Poon’s insurer, Farmers Insurance Group of Cos. Monroy and Campos alleged that Poon was negligent in the operation of her vehicle. Monroy and Campos claimed that they were proceeding straight on Enrico Fermi Drive when Poon suddenly pulled out in front of them. Monroy claimed that he could not stop in time, resulting in his vehicle broadsiding Poon’s vehicle. Poon’s claims adjuster did not dispute liability., Monroy and Campos were both taken to a hospital.  Monroy was ultimately diagnosed with lumbar radiculopathy, cervical and lumbar strains, and a partial tear of the left knee’s meniscus. Monroy claimed he has no limitations. However, his treating physician recommended a future L4-5 laminotomy and discectomy. Monroy sought recovery of $18,794 in past medical costs and $140,000 in future medical costs for the facility fee, the surgeon fee and the assistant surgeon. He also sought recovery of damages for his past and future pain and suffering. (Monroy’s property damage of $5,575.46 had already been paid by his own insurance company.) Campos suffered a brief loss of consciousness at the scene. He was diagnosed with lumbar radiculopathy and a partial tear of the left knee’s medial meniscus. Campos received left knee injections, but he ultimately required arthroscopic surgery. Campos claimed he has no limitations as a result of his . Campos sought recovery of past medical costs, and damages for his past and future pain and suffering.
