At various times during a period that spanned 2012 and September 2017, the charging party and other similarly situated individuals, all Hispanic, were employees of the Fresno office of Pape Material Handling Inc., a seller, renter and servicer of forklift products. The workers claimed that they were subjected to persistent harassment based on their national origin. The U.S. Equal Employment Opportunity Commission, acting in the workers’ behalf, sued Pape Material Handling. The lawsuit alleged that the workers were subjected to harassment that constituted a violation of Title VII of the Civil Rights Act of 1964. The EEOC claimed that Pape Material Handling’s employees were allowed to mock the accents of Hispanic employees and use derogatory slurs. It also claimed that the company failed to address employee complaints, leaving the targeted employees to quit as their only recourse to avoid the misbehavior. Pape Material Handling claimed that it was unaware of any alleged inappropriate conduct., The EEOC sought injunctive relief. It also sought recovery of lost benefits and pay, as well as emotional-distress damages on behalf of the impacted employees.
