FACTS
On June 25, 2009, plaintiffs’ decedent Michael Jackson, 50, suffered a cardiac arrest at his residence on North Carolwood Drive in the Holmby Hills neighborhood of Los Angeles. His personal physician, Conrad Murray, said that he had found Jackson in his room, not breathing and with a barely detectable pulse, and that he administered CPR, to no avail. Jackson was later pronounced dead. The Los Angeles County Coroner determined that Jackson had lethal levels of the anesthesia drug propofol in his body at the time of death. Murray was ultimately convicted of involuntary manslaughter in 2011, and he has appealed that conviction. Jackson’s mother, Katherine Jackson, and his three minor children, Michael Jackson Jr., Paris-Michael Jackson and Prince Jackson II, sued AEG Live LLC, AEG Live Productions LLC, Anschutz Entertainment Group Inc., Paul Gongaware, Timothy Leiweke, Kenneth Ortega and Randy Phillips, alleging that the defendants were liable for the decedent’s wrongful death. Prior to trial, Ortega was voluntarily dismissed from the case, and Anschutz Entertainment Group and Leiweke were dismissed on summary judgment. Gongaware and Phillips were later dismissed on a motion for nonsuit during trial. Thus, the trial continued against AEG Live LLC and AEG Live Productions LLC only. Plaintiffs’ counsel contended that the decedent died of acute propofol and benzodiazepine intoxication, administered by Murray. Counsel further contended that Murray was negligently hired by AEG Live as the decedent’s personal physician. Counsel for AEG Live contended that the decedent, and not AEG Live, hired, supervised, and retained Murray. Counsel also contended that AEG Live did not hire or agree to pay Murray, instead agreeing only to advance funds for the decedent to hire Murray, like other members of the “This Is It” concert tour selected by the decedent. AEG Live’s counsel further contended, to the extent of Murray’s hiring, that Murray was hired only to serve the decedent’s general medical needs and that AEG Live had no knowledge of Murray’s administration of the hospital-grade anesthetic propofol to the decedent in a home setting., After a call was placed to 911 at 12:20 p.m. on June 25, 2009, Michael Jackson was treated by paramedics at the scene and was later pronounced dead at the Ronald Reagan UCLA Medical Center. It was later determined that the decedent had lethal levels of propofol in his body at the time of death. He was 50 years old, and is survived by his family, including his mother, Katherine Jackson, and his three minor children, Michael, Paris-Michael and Prince. Thus, the decedent’s mother and three children sought recovery of wrongful death damages.
