From June 8, 2013 to Aug. 21, 2018, plaintiffs Chelsea Hamilton and Alyssa Hernandez, employees at a Wal-Mart fulfillment center in Chino, were allegedly not provided proper meal breaks or proper overtime compensation. The claimed other, similarly-situated employees were also affected by the company’s actions. Hamilton and Hernandez, acting individually and as representatives of a class of 4,840 persons at a Wal-Mart fulfillment center in Chino, sued their employers, Wal-Mart Stores Inc. and Wal-Mart Associates Inc. Hamilton and Hernandez alleged that the defendants failed to provide proper meal periods and/or overtime compensation to its employees, in violation of the California Labor Code. Plaintiffs’ counsel contended that Wal-Mart failed to provide lawful meal periods by requiring employees to undergo an off-the-clock security check before exiting the premises, which would prevent employees from leaving the facility for their meal breaks. Counsel also contended that the company improperly implemented an alternative workweek schedule, resulting in a failure to pay overtime compensation, as required by California law, for hours worked between eight and 10 hours a day. Wal-mart denied the plaintiffs’ allegations., Hamilton and Hernandez, acting individually and on behalf of the class of 4,840 persons, sought recovery of the unpaid wages owed to them.
