Between July 2009 and February 2010, plaintiff Pedro Gollaz, a driver in his 20s, was on reserve duty. However, he claimed that when he attempted to return to his position at Cambridge Hospitality Inc., the company would not re-employ him. Gollaz sued Cambridge Hospitality Inc. He alleged that the defendant’s actions constituted wrongful termination in violation of public policy and violations of California’s Military and Veterans Code § 394. Gollaz claimed that upon his return from reserve duty, the company only offered him a position in laundry, working two days a week for 16 hours. At trial, Cambridge Hospitality claimed that it offered Gollaz a nine-to-five position, working Monday through Friday, but that he turned it down., Gollaz sought recovery of damages for his loss of earnings as a result of not being able to return to his previous position. He also sought recovery of compensatory damages, punitive damages, attorney fees and pre-judgment interest. According to defense counsel, Gollaz requested a verdict of $100,000, inclusive of $32,000 in past wages and $64,000 in punitive damages.
