FACTS
On June 30, 2010, plaintiff Maly Sun, 36, a data entry clerk, was fired one day after requesting medical leave from her job at Transit Air Cargo Inc. Sun sued Transit Air, alleging disability discrimination and failure to comply with the California Family Rights Act, which may provide time off for treatment of certain medical conditions. Sun claimed she was terminated one day after informing her employer of a medical condition and requesting time off for surgery. Thus, she claimed that Transit Air wrongfully terminated her for requesting the time off, despite her employer’s claim that it terminated her for other legitimate business reasons Transit Air claimed that it had a plan in place to fire Sun based on a reduction in force and performance issues prior to her requesting medical leave., Sun claimed that she suffered lost wages, lost benefits and emotional distress as a result of being fired. Thus, she sought recovery of damages for her lost wages and benefits and pain and suffering.
