FACTS
On June 10, 2016, plaintiffs’ decedent Mitzi Campbell, 58, a construction worker, was working on a construction project in San Francisco, where ANI Private Security and Patrol Inc. provided security that included access to the project. The general contractor on the project, Cahill Contractors Inc., was also responsible for access/egress to the construction site and for general safety on the project. Lizette Cauich asked to use a portable toilet at the site, but Cahill Contractors denied her access. As Campbell was escorting Cauich away from the premises, Cauich stabbed Campbell once in the upper, right chest and twice in the lower, left abdomen. Campbell later died while being taken to a hospital. Campbell’s adult son, Leslie Walker, and granddaughter, Amari Walker, sued Cauich; ANI Private Security and Patrol Inc.; Cahill Contractors Inc.; and the believed owners of the property, 923 Folsom Acquisition, LLC, Align Real Estate, LLC and Pacific Structures Inc. Campbell’s family alleged that ANI Private Security, Cahill Contractors and the property owners inadequately and/or negligently provided security at the construction site, which led to Campbell’s stabbing. They also alleged that Cauich intentionally assaulted Campbell, causing her wrongful death. Cahill Contractors and the property owners settled out of the case for undisclosed amounts, and ANI Private Security was dismissed from the case after being granted summary judgment. The matter continued against Cauich only., Campbell sustained puncture wounds and lacerations to her upper, right chest and lower, left abdomen as a result of being stabbed. She ultimately died while being transported to a hospital. She was survived by her adult son, Leslie Walker, and minor granddaughter, Amari Walker. Campbell’s family sought recovery of wrongful death damages for the loss of Campbell.
