On June 3, 2009, plaintiff Christian Bracamontes, 28, an inmate at Centinela State Prison in Imperial, alleged that Correctional Sergeant Moya, Correctional Officers Lopez and Lizarraga, and an associate warden used excessive force against him because they mistakenly believed he was involved in a stabbing attack on a plumber at the prison. He also alleged the correctional officers conspired to use excessive force against him and that after the incident, he was not provided with adequate medical care. Bracamontes sued Correctional Sergeant Moya; Correctional Officers Lopez and Lizarraga; and the unidentified associate warden. Bracamontes alleged that the defendants’ actions constituted excessive force in violation of his Eighth Amendment rights, as well as constituted deliberate indifference to his medical needs and conspiracy. The defendants denied using any force against Bracamontes., Bracamontes claimed he sustained a scratch and a bump on his forehead, as well as a scrape on his elbow. He also claimed bruises and soreness. Bracamontes was subsequently evaluated medically, but received no treatment. Defense counsel argued that Bracamontes’ alleged bruises and soreness were not supported by the evidence. Counsel also noted that three days after the incident, Bracamontes showed no signs of swelling on his forehead. In addition, defense counsel argued that Bracamontes was medically evaluated after the incident, but it was determined that he did not require treatment.
