On Dec. 1, 2009, plaintiff Josefina Kenline began working as a City Manager for the city of La Puente. She claimed that since almost the start of her employment, she was subjected to a sexually hostile work environment by Councilman John Solis. Kenline sued the city of La Puente and Solis under several theories, including breach of contract, sexual harassment, gender discrimination, retaliation and violations of California Labor Code §§ 1102.5 and 95. Kenline claimed that Solis touched her inappropriately, requested sexual favors from her and subjected her to unwanted sexual innuendos. She alleged that she protested the harassment and made complaints to the City Council, City Attorney and human resources personnel, but that after she reported it, she was retaliated against in the form of heightened scrutiny of her work and being stripped of her authority, which included the ability to retain or release subordinates. Kenline also claimed that she was ultimately constructively discharged from her position on Dec. 16, 2010. Defense counsel contended that Kenline had problems since she first took the job and that this was shown by her needing three performance reviews scheduled by the council in her first five months on the job. Defense counsel also contended that Kenline resigned from her job willingly and then told reporters she had another opportunity already lined up., Kenline claimed she suffered from emotional distress as a result of the harassing conduct. She also claimed that she was denied $160,000 in severance pay and that her professional reputation was damaged by the conduct of the defendants.
