FACTS
At around 5:30 p.m. on Oct. 13, 2014, claimant Gregory Hoffman, 56, a motion picture key grip, was operating his 2014 MINI Cooper in Santa Clarita with claimant Jyoti Hoffman, 44, a fashion designer, as a front seat passenger. Their vehicle was ultimately rear-ended by an uninsured motorist. The Mini Cooper was declared a total loss. Mr. Hoffman also claimed to his neck and lower back, and Ms. Hoffman claimed to her lower back and a knee. The Hoffmans sought recovery via the supplementary-uninsured-motorist provision of their own insurance policy, which was administered by the Automobile Club of Southern California, the Southern California affiliate of the American Automobile Association. The matter proceeded to arbitration., Mr. Hoffman claimed the collision exacerbated his pre-existing herniated lumbar discs and cervical stenosis. Ms. Hoffman claimed the collision exacerbated her pre-existing lumbar stenosis and a knee’s osteoarthritis. The Hoffmans were both taken from the scene by ambulance and brought to a hospital for treatment. Thereafter, they each underwent chiropractic care and underwent orthopedic consultations. The Automobile Club of Southern California disputed the amount of damages alleged by the Hoffmans.
