On July 11, 2011, plaintiff Amanda Nalley, a student in her 20s, was driving on State Route 37, also known as Sears Point Road, in Napa County when her vehicle was rear-ended by a vehicle operated by Meghan Lucas. Nalley sustained to her neck, back and right, dominant shoulder. Nalley sued Meghan Lucas and the owner of her vehicle, Kaya Lucas. Meghan and Kaya Lucas ultimately stipulated to liability, and the matter proceeded to an expedited jury trial under C.C.P. § 630.01 et seq., Nalley brought herself to a hospital on the evening of the accident. She claimed soft-tissue to her neck, back and right, dominant shoulder, as well as neck and back sprains. One month after the accident, Nalley began chiropractic care, which she continued for four months. Nalley claimed that following treatment, she has no limitations, but does suffer lingering aches that come and go when she sits or drives too long. Thus, she sought recovery of $5,346 in medical costs and an unspecified amount for her pain and suffering. Defense counsel stipulated to Nalley’s full medical expenses and causation, but disputed the extent and value of her treatment.
