FACTS
On July 28, 2008, plaintiffs’ decedent Pamela Goudie-Fayed, 44, who was in the process of filing for divorce, was walking to her car in a parking garage when she was fatally stabbed. Earlier that day, Goudie-Fayed met with her husband, James Fayed, and their respective criminal attorneys at an office in Century City. Fayed and Goudie-Fayed retained criminal attorneys because, at the time of their pending divorce, their joint business, Goldfinger Inc., was being investigated by the F.B.I. After the meeting, while Goudie-Fayed was walking to her car in the office’s parking garage, she was stabbed by two assailants who came out of a parked van. Goudie-Fayed died from the fatal stab wounds. Fayed was subsequently found guilty of first-degree murder, with special circumstances for arranging his wife’s murder, and was sentenced to death. During the criminal trial, testimony revealed that Fayed paid his ranch manager, Jose Moya, $25,000 to coordinate the stabbing of Goudie-Fayed, which was carried out by two accomplices. Key evidence at the trial included that the van carrying the assailants was rented by Fayed’s company (Goldfinger Inc.), and that surveillance footage showed several people rushing to Goudie-Fayed after hearing her screams, while Fayed stood still. Desiree Goudie, acting individually and as representative of the Goudie-Fayed’s estate, and Jeanett Fayed filed a civil action against Fayed for causing the decedent’s wrongful death. (Desiree is the biological daughter of decedent and step-daughter of defendant, while Jeanett is the biological daughter of both decedent and defendant.) Shortly after he was sentenced, Fayed entered into a stipulated judgment on the plaintiffs’ wrongful death action., Goudie-Fayed was fatally stabbed by two assailants hired by her husband. She died on July 28, 2008. She was 44. Goudie-Fayed left behind two daughters; Desiree, who was 18, and Jeanett, who was 9 years old. Goudie-Fayed’s daughters sought recovery for their mother’s wrongful death.
