At around 7:28 a.m. on March 22, 2016, plaintiffs’ decedent Jae Hee Song, 60, was attempting to cross eastbound Apperson Street, outside of a crosswalk, in a residential neighborhood in Los Angeles, when she was struck by a Dodge Durango operated by Vickie Rigdon. Song later died from her . The decedent’s husband, Sung Tae Song, their two adult children, Young Min Song and Edwin Song, sued Rigdon. The Song family alleged Rigdon was negligent in the operation of her vehicle. Rigdon claimed that she was driving the speed limit of 25 mph on her way to work and that she was putting on her sunglasses because of the glaring sun when she struck Song. However, she claimed that Song was at fault for crossing the street outside of a crosswalk. Defense counsel noted that the investigating police officers concluded that Song was at fault for the accident for crossing the street outside of a crosswalk and crossing diagonally through the intersection., Jae Hee Song, 60, sustained blunt force trauma.
