FACTS
In November 2013, plaintiff Otilia Dorian, a woman in her 80s, was driving on southbound Sunset Boulevard, in San Francisco. As she entered the intersection with Irving Street, Dorian’s vehicle was struck by a truck operated by Anthony Gauer, who was traveling on westbound Irving Street. The force of the collision caused Dorian’s vehicle to spin and propel onto the sidewalk. The vehicle was totaled, and Dorian sustained to her neck and back. Dorian sued the driver of the truck, Anthony Gauer, and the truck’s owner, Gina Gauer. Dorian alleged that Mr. Gauer was negligent in the operation of the truck and that Ms. Gauer was vicariously liable for Mr. Gauer’s actions. Specifically, Dorian contended that Mr. Gauer ran a red light on Irving Street, causing the collision., After the collision, Dorian was taken to San Francisco General Hospital, in San Francisco. She then treated at a Kaiser Permanente facility for soft-tissue to her neck and back. Dorian had a medical lien of approximately $28,000 to $29,000. She had no surgeries, and she claimed her had resolved. Thus, Dorian sought recovery of past medical costs and damages for her past pain and suffering.
