FACTS
In 2004, plaintiff Lolita Schagene began work as a cashier at a Navy marina in Coronado, Calif. She ultimately resigned from her position due to alleged chronic obstructive pulmonary disease (COPD) in 2011. However, Schagene claimed that during the time of her employment, she was subjected to continued discrimination and harassment by her supervisors at Fiddler’s Cove Marina. Schagene sued Raymond Mabus, Secretary of the Navy. Schagene alleged that Mabus’ actions constituted gender discrimination, sexual harassment, and retaliation under Title VII. Schagene claimed that she was continually subjected to sexual discrimination and harassment by her supervisors during the time of her employment. She also claimed that there was even an incident wherein a co-worker and supervisor ordered someone to rape her. Defense counsel noted that Schagene made her discrimination and harassment allegations for the first time months after her resignation. Counsel also argued that Schagene suffers from paranoid delusional disorder and schizophrenia and that none of the alleged acts actually occurred., Schagene claimed that she suffered emotional distress as a result of her treatment while working at Fiddler’s Cove Marina. Thus, she sought recovery of damages for her emotional distress. The plaintiff’s treating psychologist was called to testify about Schagene’s alleged emotional distress. However, according to defense counsel, the plaintiff’s treating psychologist confirmed Schagene’s diagnoses of delusional disorder and schizophrenia.
