In 2012, plaintiff Nagui Mankaruse, 67, a mechanical engineer for Raytheon Co., a defense contractor, was let go from his job at the Fullerton facility. Mankaruse claimed he was subjected to comments and harassment by coworkers and managers, and ultimately terminated due to his age and heart condition. Mankaruse sued Raytheon Co. and his supervisors, James Weber and Kenneth Gillette. Mankaruse alleged that the defendants’ actions constituted age discrimination, disability discrimination, retaliation, and failure to prevent discrimination and retaliation. Mankaruse contended that he worked for Raytheon since 2004, but that in 2012, he began to be subjected to comments from managers about how he was “too old and sick” to work. He claimed that he had to take a medical leave of absence due to his heart condition and that he was retaliated against for taking the medical leave. Thus, Mankaruse claimed that he was discriminated against based on his disability and that he was terminated from his position due to his heart condition. He also claimed that he was harassed by coworkers about his accent and English language skills. Defense counsel argued that Raytheon maintains a strict anti-discrimination and anti-harassment policy. Thus, counsel disputed all of Mankaruse’s allegations., Mankaruse claimed he suffered emotional distress as a result of his treatment at Raytheon and his subsequent termination. He alleged that as a result, he sought treatment from mental health care providers. Thus, Mankaruse sought recovery of compensatory damages for his emotional distress and lost earnings. He also sought recovery of punitive damages.
