In 2015, plaintiff Phong Hai Nguyen, a dental office employee in his 40s, got into a dispute with his boss, Dr. Thanh Ngoc Nguyen, and Thanh Nguyen’s sister, Christine Bui-Tillman, who also dealt with the business. Phong Nguyen ultimately stopped working as part of the front office staff for the dental office of Dr. Thanh Ngoc Nguyen. Phong Nguyen sued the dental office, Thanh Ngoc Nguyen, D.M.D., Inc.; the owner, Thanh Nguyen; and Thanh Nguyen’s daughter, Christine Bui-Tillman. Phong Nguyen alleged that he was wrongfully terminated in retaliation for objecting to the office’s questionable billing practices. Defense counsel contended that Phong Nguyen got into an argument with Thanh Nguyen and her daughter because he wanted more money for his position, while Thanh Nguyen and Bui-Tillman criticized Phong Nguyen’s work performance. Counsel also contended that after the argument, Phong Nguyen stormed out and did not return the keys to the office. Thus, defense counsel argued that there was no violation of public policy, as Phong Nguyen quit and was not terminated, and that Phong Nguyen had never before complained about the office’s billing practices. Counsel further argued that Phong Nguyen was removing medical records from the office, taking photos of them, and then returning the records in an attempt to prove his billing practices claim. However, the medical records were excluded from evidence., Phong Nguyen worked at the office for eight years. Thus, he sought recovery of damages for his emotional distress as a result of the alleged retaliation and loss of his job.
