FACTS
On June 12, 2011, plaintiff Alasia Christopher, 44, a real estate broker, was at a valet station in the parking lot of the Hollywood Bowl, in Los Angeles, when she proceeded to retrieve her and her group’s belongings before they went to a concert. While Christopher was standing behind her vehicle, a vehicle operated by Richard Whitanis moved forward and struck her. Christopher subsequently landed on the hood of Whitanis’ vehicle and rolled off, landing on the pavement. She claimed to her lower back, hips, shoulders, knees, and buttocks. Christopher sued Whitanis, alleged that Whitanis was negligent in the operation of his vehicle. Whitanis claimed he inadvertently hit the gas pedal while in his vehicle, causing it to go forward. Thus, he admitted liability, and the matter proceeded to an expedited jury trial., Christopher claimed she suffered soft-tissue to her lower back, hips, shoulders, knees, and buttocks. She was subsequently taken by ambulance to a hospital. After she was released from the emergency room, she treated with a medical physician who had a physical therapist at the office. As a result, Christopher underwent seven months of physical therapy at that location. After completing her course of physical therapy, Christopher claimed she still had residual pain in the areas of her . She also claimed she had continued limitations, but there were no recent medical examinations. Thus, plaintiff’s counsel asked the jury to award $50,000 for Christopher’s pain and suffering. Defense counsel disputed the reasonableness of Christopher’s general damages and argued that it was too excessive. Thus, in closing, defense counsel suggested that the jury award Christopher only $6,000. However, plaintiff’s counsel denied that defense counsel asked the jury to award $6,000.
