FACTS
In May 2011, plaintiff Aurora Shasby, 59, a financial administrator for Amalfi Semiconductor Inc., was terminated due to an alleged elimination of her position. However, Shasby claimed she was terminated due to her age. Shasby sued Amalfi Semiconductor Inc. and a professional employment organization that was her technical employer, TriNet HR Corp. TriNet was ultimately dismissed from the case. Shasby claimed that she worked for Amalfi Semiconductor since 2007, but that as she approached 60-years-old, she was replaced by a younger employee. Defense counsel contended that Amalfi Semiconductor upgraded Shasby’s position to an accounting manager and hired someone who obtained a CPA license. Counsel contended that as such, Shasby was not replaced, but the certified public accountant was hired to work in the new position., Shasby claimed she suffers emotional distress and anguish, as well as a substantial loss in earnings. Thus, Shasby sought recovery of lost wages. She also sought recovery of emotional-distress and punitive damages.
