FACTS
On Dec. 16, 2009, at 7:30 p.m., plaintiff Alicia Belteton, 50, an office cleaner, was crossing Bedford Drive mid-block near Brighton Way in Beverly Hills when she was struck by the rear of a vehicle operated by Darian Robin, who was reversing her car into a parallel parking space. Belteton fell and claimed head, spine, hip and abdominal . Belteton sued Robin, alleging that the defendant was negligent in the operation of his vehicle. Defense counsel noted that on the night of the subject accident, it was dark out and Belteton was jaywalking. The defense cross-examined Belteton with evidence of four other injury claims Belteton made in 2009, for which she retained four separate attorneys and filed four separate lawsuits. Defense counsel noted that this claim made the fifth injury suit filed by the plaintiff for a 2009 loss. As such, counsel argued that this injury claim was a fraud and that Belteton likely waited for it to get dark, then snuck up next to Robin’s slow moving car, slapped it on the side, and then dropped herself to the pavement, feigning injury., This case was submitted to the Expedited Jury Trial program with no floor and an agreed cap of $50,000. Plaintiff’s counsel was permitted to introduce into evidence Belteton’s medical records and bills without producing a medical expert to lay foundation. Belteton alleged unspecified pain to the neck, lower back, left hip and abdomen, She also claimed she suffered headaches as a result of the accident in question. Belteton was transported from the scene to Cedars-Sinai Medical Center, where she was hospitalized for two nights and accrued a bill of $34,264.87. Defense counsel denied that Belteton suffered any injury, whether she was hit by Robin’s slow moving vehicle or not. The defense’s orthopedic expert testified that Belteton was excessively treated and billed at Cedars-Sinai, and none of the diagnostics performed during her stay at the hospital revealed any sort of injury.
