On July 27, 2009, plaintiff Christopher Redd, 43, a video editor, was retrieving his dog when he accidentally bumped into a wall in a single family home he resided at, which was located on Herrick Avenue in the Pacoima/San Fernando area. He claimed the wall fell on him, causing numerous bricks to strike him all over his body, including his head. Redd sued the owner of the house, Jambry Scott. He alleged that Scott failed to properly repair and/or maintenance of the wall, creating a dangerous condition. Redd also alleged that after he moved into the house, he found that it was “unlivable” due to plumbing and other issues. Defense counsel contended that in March 2009, a few months after Redd moved into the home, Redd called the City Building Department and complained about various items, including the wall in question. Counsel noted that the city inspector appeared at the house and cited Scott, indicating that the wall did not comply with the Building Code. However, counsel contended that the inspector also stated that the wall was not in imminent danger of falling and warned Redd about the potential dangers of the wall. Defense counsel asserted that as a result, yellow warning tape was placed on the wall the next day, but that Redd claimed he never saw it. Defense counsel called several witnesses who testified that Redd had discussed “staging” an accident prior to the event. Counsel contended that several days after Redd had discussed staging the accident, and prior to the last day given by the city to correct the condition, the alleged wall incident occurred. In response, Redd denied having called the city inspector and denied having had any knowledge of the detective status., Redd claimed he suffered a mild to moderate brain injury, as well as throughout his body due to being struck by falling bricks. He also claimed he required surgery to treat to his neck, back, left shoulder and left knee. According to defense counsel, paramedics were summoned to the scene after the alleged accident, but found no bumps, bruises or bleeding anywhere on Redd’s body. Counsel also noted that similar findings were the result of Redd’s emergency room visit. Thus, defense counsel argued that after hiring a lawyer, Redd went to several doctors until he was diagnosed with a brain injury.
