On July 18, 2015, plaintiffs’ decedent Armando Sahagun, 22, a stadium worker, plummeted from the Pasadena Avenue Bridge, in Los Angeles, and was struck by vehicle traveling on the Arroyo Seco Parkway (State Route 110), which runs under the bridge. Sahagun was pronounced dead at the scene. Surveillance footage showed Sahagun on the bridge, with no one else present, but it did not show Sahagun’s fall. Sahagun’s mother, Eva Zatarian, and minor son, Matthew Sahagun-Zendejas (through a guardian ad litem), sued the driver of the vehicle that struck Sahagun, Saul Morales; the owner of Morales’ vehicle, Yessica Feria; and the maintainers of the bridge, the city of Los Angeles and the state of California (acting by and through the Department of Transportation). Sahagun’s family alleged that Morales was negligent in the operation of his vehicle and that Feria was vicariously liable for Morales’ actions. The family also alleged that the city and state failed to properly repair and/or maintain the bridge, creating a dangerous condition of public property. Morales and Feria were dismissed from the case, and the matter continued against the city and state. Plaintiffs’ counsel contended that Sahagun’s death was an accident, in that the decedent tripped and fell over a low bridge railing. Counsel maintained that the railings on the bridge were too low and that Sahagun would not have fallen if it had not been for the low railing. Plaintiffs’ counsel also contended that the area was poorly maintained, resulting in cracks on the sidewalk and a large weed that possibly tripped Sahagun. While there were no witnesses at the top of the bridge, a driver below it testified that she saw Sahagun hanging onto the side of the bridge. Plaintiffs’ counsel argued that, based on what the witness saw, Sahagun did not want to die, so the fall was not suicide. The plaintiffs’ biomechanical expert opined that the alleged tripping mechanisms on the bridge of the sidewalk and weed were more likely what caused Sahagun to fall over the bridge. Defense counsel noted that the Los Angeles Police Department concluded that Sahagun’s death was a suicide and not an accidental fall. Counsel also noted that blood alcohol testing showed that Sahagun was heavily intoxicated. Counsel further noted that there were statements entered into trial of people that spoke with Sahagun prior to the events and that they claimed that Sahagun was depressed. However, defense counsel contended that there was no explanation as to why Sahagun went to the bridge. The defense’s accident reconstruction expert opined that it would be impossible to trip over the alleged mechanisms on the bridge and then land where Sahagun did. The expert further opined that if Sahagun had tripped, Sahagun would have been located farther then where he was underneath the bridge., Sahagun sustained traumatic and died at the scene on July 18, 2015. He was 22 years old. Sahagun was survived by his mother, Eva Zatarian, and his 2-year-old son, Matthew Sahagun-Zendejas. Prior to his death, Sahagun worked at Dodger Stadium and lived with his mother. While Sahagun’s son lived with his mother, plaintiffs’ counsel contended that Sahagun and Matthew were very close. Counsel also disputed that Sahagun would have committed suicide due to his close relationship with his son. Zatarian and Matthew sought recovery of $31 million in total wrongful death damages.
