In 1990, plaintiff Rochell Estes, an African American, was hired as an eligibility technician by the County of Orange Social Services Agency. After several years had passed in which she didn’t get a promotion, Estes began making internal and external complaints, alleging that she was not promoted because of her race. She was eventually promoted to the position of eligibility supervisor on a probationary basis in October 2007. However, after nine months of the probationary period, Estes was demoted back to eligibility technician on the alleged ground that she did not meet the core expectations of an eligibility supervisor. She was also relocated to a different office and placed under a new supervisor. Estes sued the County of Orange Social Services Agency. She alleged that the agency’s actions constituted racial discrimination, harassment and retaliation. Estes contended that she was not offered the promotion for several years due to her race. She also contended that once she was ultimately promoted on a probationary basis, her employer retaliated against her for making the previous complaints of race discrimination by demoting her back to her original position, as well as relocating her and giving her a new supervisor. In addition, Estes contended that her new supervisor harassed her due to her race. The County of Orange Social Services Agency denied Estes’ allegations and claimed Estes was demoted back to eligibility technician because she failed her probationary period because she did not complete the core requirements of an eligibility supervisor., Estes sought recovery of compensatory damages as a result of her demotion and alleged discrimination, harassment and retaliation.
