In June 2013, plaintiff Dedrick Hill, a black, account manager in his 40s, was terminated from his position at C.R. England Inc., a transportation company. Hill claimed that he was fired because of his race. Hill sued C.R. England Inc., alleging racial discrimination. Hill contended that he felt discriminated against at work. (Editor’s Note: The docket incorrectly listed the plaintiff’s name as “Derrick” Hill.) Defense counsel argued that Hill was terminated because he retaliated against a black female supervisee who had complained about Hill. Counsel contended that Hill’s retaliation against the supervisee included banning her from the premises, and noted that eyewitnesses saw Hill tell the security team that the supervisee was not allowed on the premises. Thus, defense counsel argued that the company had a legitimate, non-discriminatory, business reason for terminating Hill, as C.R. England was trying to protect the supervisee. In response, Hill denied retaliating against the supervisee., Hill worked at C.R. England from January 2013 until his termination in June 2013. He claimed he suffered emotional distress and stress as a result of the incident. However, he did not seek counseling. Thus, Hill sought recovery of back pay, forward pay, and emotional-distress damages. He also sought recovery of punitive damages.
