Plaintiff Sara Gum was employed as a sales manager for Handelonthelaw.com, LLC, an attorney-listing service, while her three daughters, plaintiffs Kelly Gum-Roman, Shannon Becker and Brianna Seckner, worked as subordinates under her. They all worked for the company from their respective homes. In April 2010, Gum-Roman and Becker were terminated from their positions. Gum-Roman was over eight months pregnant at the time. In February 2011, Gum and Seckner were terminated from their positions. Seckner was 7.5 months pregnant when she was terminated. Gum, Gum-Roman, Becker and Seckner sued Handel on the Law Productions LLC, William Handel, the Center for Surrogate Parenting Inc., Handelonthelaw.com and Karen Synesiou. The plaintiffs originally brought 17 causes of action against the defendants. However, William Handel, the Center for Surrogate Parenting Inc. and Synesiou were ultimately dismissed from the case on various motions for summary judgment, and Handel on the Law Productions LLC was dismissed from the case at the close of a bench trial. Thus, the matter only proceeded to a jury trial against Handelonthelaw.com on claims of gender and pregnancy discrimination, failure to reimburse, failure to pay overtime, failure to pay vacation, failure to pay commissions, intentional infliction of emotional distress and improper recordkeeping. Counsel for Handelonthelaw.com contended that there were legitimate business reasons for all of the plaintiffs’ terminations and that each plaintiff was paid everything they were entitled to., Gum, Gum-Roman, Becker and Seckner sought recovery of unpaid overtime, unpaid vacation, past and future wages for discrimination, punitive damages, and damages for their alleged emotional distress.
